In July 2021, baby Emma Johnson was born prematurely at 29 weeks  gestation, weighing just 3.1 pounds, at St. Francis Hospital in Dallas, Texas.  Due to her mother’s inability to produce breast milk and the unavailability of  donor milk, Emma was fed Similac Milk Fortifier during her NICU stay— confirmed in her medical records. On her 14th day of life, at a gestational age  of 31 weeks, Emma was diagnosed with Necrotizing Enterocolitis (NEC), a  severe intestinal condition. She underwent emergency surgery to remove  parts of her necrotic small intestine after suffering an intestinal perforation.  Over time, Emma developed scarring and strictures in her intestines and  required a feeding tube for ongoing nutritional support. At 18 months old, she  was diagnosed with cerebral palsy and continues to experience significant  developmental delays. Now three years old, Emma is under the care of a  pediatric neurologist and a gastrointestinal specialist. Her case qualifies for  the NEC mass tort as it involves confirmed exposure to a cow’s milk-based  fortifier, a timely NEC diagnosis, and multiple serious, long-lasting injuries.
