2. Eligibility
The Company understands the importance of protecting minors’ online privacy. The Service is not intended nor directed to children under the age of 13 and, therefore the Company does not knowingly collect personal information from children under the age of 13. If you are the parent or guardian of a child under the age of 13 and believe we have collected personal information about your child, please contact admin@momentumlegalgroup.com. If you are under 13, do not use the Service. If you are under 18, you must have parent or guardian permission to use the Service.
Parents or guardians who permit their children to use the Service agree to these Terms on behalf of the child.

This includes SMS messages for account notifications, customer care, and outbound 2 factor authentication. Message frequency varies. Message and data rates may apply. 6. License

10. DMCA Copyright Policy
You may not post, distribute, or reproduce any copyrighted material, trademarks, or proprietary content without written permission from the owner. Momentum Legal Group follows the Digital Millennium Copyright Act (DMCA) and may terminate access for users who repeatedly infringe others’ copyrights.
If you believe your copyrighted work has been posted on our Service without authorization, send a notice including the following:
Your physical or electronic signature
A description of the copyrighted work
The URL or location of the infringing material
Your contact information (address, phone, email)
A statement that you have a good faith belief the use is unauthorized
A statement under penalty of perjury that the above is accurate and you are the copyright owner or authorized to act on their behalf

False claims may result in legal consequences, including monetary damages and attorney’s fees under federal law.
If you believe your content was removed by mistake, you may send a counter-notice including:
Your physical or electronic signature
Identification of the removed material and its prior location
A statement that you believe the removal was a mistake
Your contact information
A statement consenting to jurisdiction in Orange County, California, and agreeing to accept service of legal process from the original complainant
If we receive a valid counter-notice, we may restore the content unless the original copyright holder takes legal action.
11. Mobile Use
Our Service may be accessible on mobile devices. We are not responsible for issues beyond our control, such as:
Connectivity failures
Mobile network outages
Device limitations or service interruptions
You assume all risks related to mobile access.

By using the Service, you consent to the transfer and processing of your data in the United States.

a. Investigations

Recover costs or damages
Take legal or technical action to prevent further misuse
c. Reporting
We may report any illegal or suspicious behavior to law enforcement and comply with legal requests or subpoenas.
17. Indemnity
You agree to defend, indemnify, and hold harmless Momentum Legal Group, its affiliates, officers, directors, employees, agents, and contractors from and against all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from:
(i) Your use of or access to the Service
(ii) Your violation of any provision of these Terms
(iii) Your violation of any third-party right, including intellectual property or privacy rights
(iv) Your violation of any law or regulation
(v) Any content submitted by you or through your account
(vi) Any claim or penalty by a tax authority related to your activity on the Service
(vii) Any other party’s use of the Service using your credentials
This indemnification obligation will survive these Terms and your use of the Service.
18. No Warranty
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties, including:
Implied warranties of merchantability, fitness for a particular purpose, and non- infringement
Accuracy, reliability, or correctness of content
Service availability or error correction
Virus- or malware-free functionality
Any content downloaded or obtained through the Service is at your own risk. You are solely responsible for any resulting damage or data loss.
Momentum Legal Group does not guarantee or endorse any third-party product or service advertised through the Service. We are not responsible for your dealings with such third parties.
19. Limitation of Liability
To the maximum extent permitted by law, Momentum Legal Group and its affiliates, officers, directors, employees, agents, and licensors are not liable for:
Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, goodwill, or other intangible losses
Any issues resulting from:
Unauthorized access to your account or information
Bugs, viruses, or harmful software
Errors, inaccuracies, or omissions in content
User-generated content or third-party conduct (including offensive or illegal activity)
In no event will our total liability exceed the amount you paid, if any, to use the Service.
These limitations apply regardless of legal theory (contract, tort, negligence, etc.) and even if we’ve been advised of the possibility of such damages.
20. Disputes
A. Informal Resolution
If a dispute arises, please first email us at admin@momentumlegalgroup.com. We will try to resolve it informally within 60 days of receipt.
B. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Legal proceedings will take place in Orange County, California, and both parties consent to jurisdiction there.
C. Arbitration Agreement
1. Binding Arbitration
Most disputes (except class actions, small claims, or requests for preliminary relief) must be resolved through binding arbitration in Orange County, California. If you are an individual consumer in the U.S., you may elect to arbitrate in your home state.
Arbitration will follow JAMS’ Streamlined Arbitration Rules, with a retired judge as arbitrator applying California law. Arbitration replaces your right to a jury trial.
The arbitrator will resolve disputes regarding enforceability of these Terms, and their decision may be enforced in court.
If you’re an individual consumer:
You only pay a $250 filing fee; we pay the rest of the arbitration fees.
For claims under $10,000, you may choose written briefs, phone, or in-person arbitration, or go to small claims court.
Requests for preliminary injunctive relief may still be filed in court in Orange
County, CA, but all other disputes will be resolved via arbitration.
2. Class Action Waiver
You and Momentum Legal Group agree to bring disputes only on an individual basis. No class, collective, or representative claims are allowed in arbitration or court.
If this waiver is found unenforceable, the dispute must be litigated in Orange County, California, and not in arbitration.
3. Opt-Out Option
If you’re a new user, you may opt out of arbitration within 30 days of accepting these Terms by emailing us at:

Opting out affects only this arbitration clause—not any other agreement between you and Momentum Legal Group.
21. Availability and Use Outside of the United States
The Service is controlled, offered and operated from facilities in the United States. Momentum Legal Group makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with local law, including but not limited to export and import regulations. Unless otherwise explicitly stated, all materials found on the Service are solely directed to individuals located in the United States. Notwithstanding the foregoing, Momentum Legal Group retains all rights, including all Intellectual Property Rights, to the Service and the Content therein, throughout the world.
22. Notification Procedures
Momentum Legal Group may provide notifications, whether such notifications are required by law or are for marketing or other business-related purposes, to you via email notice, written or hard copy notice, or through conspicuous posting of such notice on our website, as determined by Momentum Legal Group in our sole discretion. Momentum Legal Group reserves the right to determine the form and means of providing notifications to our users, provided that you may opt out of certain means of notification as described in this Agreement.
23. Notices to California Users
Under California Civil Code Section 1789.3, California website users are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N. Market Blvd., Suite S-202, Sacramento, California 95834, or by telephone at 1(800) 952-5210.
Further, under the California Consumer Privacy Act of 2018, Cal. Civil Code §1798.100, et. seq. (“CCPA”), California website users are entitled to make verifiable consumer requests to us for a written report concerning our usage of your data up to twice annually, as well as data portability and deletion request rights. Please see the Privacy Notice for California Residents section of our Privacy Policy for information on how to submit such requests to us.
24. Trademarks
“Momentum Legal Group”, and other Service graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of Momentum Legal Group Inc. and/or its licensors and affiliates. Momentum Legal Group’s trademarks and trade dress may not be used in connection with any product or service that is not Momentum Legal Group’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Momentum Legal Group. All other trademarks not owned by Momentum Legal Group that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Momentum Legal Group.
25. General
a. Entire Agreement. This Agreement, together with any other legal notices and agreements published by Momentum Legal Group via the Service, shall constitute the entire agreement between you and Momentum Legal Group concerning the Service.
b. No Waiver. Momentum Legal Group’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision, and no waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.
c. Headings. The section titles in this Agreement are for convenience only and have no legal or contractual effect.
d. Assignment. This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Momentum Legal Group without restriction.
e. Severability. If any provision of this Agreement is unlawful, void or unenforceable by a court of competent jurisdiction, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
